The Alavi Foundation, owner of 650 5th avenue, announced that it intends to appeal an impending court decision allowing U.S. authorities to seize the building.
Last week, U.S. district Judge Catherine Forest granted a summary judgment paving the way for the seizure of the 36-story building.
The court and U.S. Justice Department see the Alavi Foundation as a front for the Iranian government, which has been placed under sanctions.
The Justice Department said in a statement that the ruling “paves the way for the largest-ever terrorism-related forfeiture.ˮ Seizure will put the federal government in possession of 650 5th Avenue, which it would ultimately most likely sell.
“We are obviously disappointed with the district court’s decision granting partial summary judgment against the Alavi Foundation,” a spokesman for the Alavi Fundation said in a statement.
“We have reviewed the decision and disagree with the court’s analysis of the facts and the law. The Foundation was ready for trial and is disappointed that it did not have the opportunity to rebut the Government evidence before a jury.
“The Foundation intends to appeal the court’s decision once final judgment is entered.ˮ
